Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of PEPR, a web-based manufacturing capacity-planning platform (the “Service”) operated by the PEPR team (“PEPR”, “we”, “us”). Please read them carefully. We may update these Terms from time to time, so we encourage you to re-read this page periodically. If you disagree with the Terms, please stop using the Service.

1. Acceptance of the Terms

By accessing or using PEPR — including signing in, viewing data, editing a project, or otherwise interacting with the Service — you agree to be bound by these Terms. If you are using PEPR on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and “you” refers to both you individually and the organization.

2. Who can use PEPR

PEPR is a business-to-business product intended for organizations engaged in manufacturing, industrial engineering, operations, NPI, or related capacity-planning activities. PEPR is not designed for consumer use.

Access is invite-only. New organizations are created by the PEPR operator after a request is received through the public “Contact Us” flow. We do not offer self-service signup. A single email invitation is issued to the organization’s primary contact, who then activates the account and creates managers and per-project teams from inside the Service.

You must be at least 18 years old and legally able to enter into binding contracts to use the Service.

4. Roles inside an organization

PEPR enforces a strict role and tenancy model at the database layer. Within a customer organization, the following roles exist:

Organization account
Read-only aggregate view across the organization’s portfolio. Manages managers and seats. Cannot edit project engineering data.
Manager
Owns and operates projects. Each manager’s projects are isolated from every other manager in the same organization; managers cannot see each other’s project data.
Admin (per project)
Edits the structure, process, resources, targets, and capacity inputs of the specific project to which they have been assigned.
Viewer (per project)
Read-only access to the specific project to which they have been assigned. Viewers cannot make any changes; this is enforced at the database layer, not only in the user interface.

The PEPR platform operator can see that customer organizations exist and can manage their lifecycle (activation, suspension, plan limits), but does nothave read or write access to the organization’s engineering internals — structure, process routes, stations, resources, and similar data are isolated from the operator at the database layer through row-level security. The operator may, however, need to access such data in narrowly scoped circumstances, such as to investigate a reported bug at the customer’s request or to comply with a binding legal request.

Each organization is provisioned under a plan that may set quantitative limits, including:

Viewers are not capped. Limits may be revised — for example, to reflect a new tier or pricing structure — with reasonable advance notice. If your organization needs higher limits, contact us at 77eran@gmail.com. You agree not to attempt to circumvent these limits, for example by registering multiple shadow organizations to evade caps.

6. What PEPR does (and does not) do

PEPR is a planning, modeling, and analytics tool. It helps you represent product structure, process routing, resources, and production targets, and it computes capacity, throughput, and bottleneck reports based on the inputs you supply.

All output — including capacity, takt, throughput, utilization, bottleneck identification, material gross-explosion schedules, and gap analyses — is illustrative and is computed directly from the data you enter. Accuracy depends entirely on the accuracy and completeness of those inputs. You are responsible for verifying any PEPR output before relying on it to make purchasing, staffing, capital, scheduling, or other business decisions. Capacity, throughput, and bottleneck reports are provided AS IS.

PEPR is not an enterprise resource planning (ERP) or materials requirements planning (MRP) system; it does not perform inventory netting, lot-sizing, or time-phased MRP. The material module is a gross, yield-aware input schedule, not a replacement for an ERP or MRP.

8. Your data, your ownership

As between you and PEPR, your organization retains all right, title, and interest in and to the data you submit to the Service (“Customer Data”), including product structures, process routes, resource definitions, targets, and any files you upload. We do not claim ownership of, or intellectual-property rights in, Customer Data.

You grant PEPR a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, copy, and display Customer Data solely for the purpose of providing the Service to you (including backups, security operations, and customer-requested support activities). We do not use Customer Data to train external models, and we do not sell Customer Data.

We may use aggregated, de-identified usage statistics about the Service (for example, the number of organizations on the platform or system performance metrics) for product analytics and operational purposes, provided that such statistics cannot reasonably be used to identify you or your organization.

9. Privacy

Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you also agree to the practices described there.

10. Subscription, fees, and billing

PEPR does not currently charge fees for the Service. We expect to introduce paid tiers in the future; when we do, these Terms will be updated and the applicable fees, billing cycle, refund policy, and payment processor will be disclosed before any charges begin. Your continued use of the Service after such changes constitutes acceptance of the updated commercial terms; if you do not agree, you may close your account before any paid plan applies to you.

11. Service availability

We provide the Service on a best-effort basis. We do not currently offer a formal service-level agreement (SLA) with uptime guarantees, response-time commitments, or service credits. Planned maintenance, updates, and infrastructure events may temporarily affect availability; we will give reasonable notice where practical for planned maintenance.

12. Termination

You may close your account at any time by contacting us at 77eran@gmail.com. On request, we will deactivate the account and, on a reasonable schedule, delete or anonymize associated Customer Data, subject to any retention required by law or for security and audit purposes.

We may suspend or terminate your access — in whole or in part — for material breach of these Terms, including (without limitation) abuse of the Service, illegal use, attempts to bypass tenancy controls, or non-payment of fees once paid plans apply to you. Where reasonably possible, we will give you advance notice and an opportunity to cure. For severe issues — such as ongoing security threats, court-ordered action, or activity that endangers other customers — we may suspend access immediately.

Sections that by their nature should survive termination (for example, intellectual property, data ownership, disclaimers, limitation of liability, indemnity, and governing law) will survive.

13. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted or error-free.

Without limiting the foregoing, we make no warranty that PEPR’s throughput, capacity, bottleneck, or material calculations will match real-world production exactly. The outputs are model outputs driven by the inputs you provide, and they are not a substitute for professional engineering, operational, financial, or legal judgment. Decisions based on PEPR output are your responsibility.

14. Limitation of liability

To the maximum extent permitted by applicable law, in no event will PEPR, its affiliates, or its suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or production output, arising out of or relating to your use of, or inability to use, the Service, whether based in contract, tort, statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Our total cumulative liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total fees you paid to PEPR for the Service in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars (USD $100) if no fees were paid.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the greatest extent permitted by law.

15. Indemnity

You agree to defend, indemnify, and hold harmless PEPR, its affiliates, and their respective officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your misuse of the Service, (b) your violation of these Terms, (c) your violation of any applicable law or regulation, or (d) your infringement of any third-party right, including any intellectual-property right, in connection with your use of the Service.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. For material changes, we will provide additional notice — by email to the address associated with your account, by an in-app banner, or both — before the change takes effect. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance of those changes. If you do not agree, you should stop using the Service and contact us to close your account.

17. Disputes, governing law, and jurisdiction

We prefer to resolve disputes informally. Before initiating any formal proceeding, you agree to contact us at 77eran@gmail.com and give us a reasonable opportunity to address the issue. If the dispute cannot be resolved directly, the parties agree to attempt good-faith mediation before initiating litigation.

PEPR will work in good faith to comply with applicable law in the jurisdictions in which it operates. The specific governing law and the courts of competent jurisdiction that apply to these Terms will be confirmed in a future revision of this page. Until that revision is published, any dispute will be heard before a court of competent jurisdiction agreed by the parties, and nothing in these Terms limits any non-waivable consumer- or data-protection rights you may have under the mandatory law of your place of residence.
